Family mediation can address a wide range of issues, including child arrangements (custody, visitation), child maintenance, division of assets, financial matters post-divorce or separation, and communication issues between family members. Mediation is flexible and can address both practical and emotional aspects of family disputes.
Mediation itself is not legally binding. However, any agreement reached during mediation can be made legally binding if both parties choose to formalise it through a court order, such as a consent order. This step ensures the agreement is binding and can be legally enforced. We would be happy to discuss and assist you through this process.
The mediation process typically starts with an introductory meeting called a Mediation Information and Assessment Meeting (MIAM), where both parties assess whether mediation is appropriate for their situation. The mediator then facilitates discussions between both parties to help them reach an agreement. It may involve a series of meetings and can cover various issues, depending on the needs of the family. Throughout, the mediator remains neutral and does not offer legal advice. If matters can be agreed then this can be referred to us so can prepare the necessary documents to formalise it or if an agreement cannot be reached, the mediator will provide you with a certificate which will allow you to initiate court proceedings.
You do not need a solicitor to attend mediation, but it can be helpful to consult one before or after mediation, particularly to ensure that any agreements you reach are fair and legally sound.
